Bunlardan biri məhkumluğu olan bir sıra şəxslərin övladlığa uşaq götürməsinə qoyulacaq məhdudiyyətlərdir. Belə ki, Azərbaycanda ailə münasibətləri əleyhinə ağır cinayət törədən şəxslər övladlığa uşaq götürə bilməyəcəklər. Bununla bağlı Ailə Məcəlləsinin 120-ci maddəsinə (övladlığa götürmək hüququ olan şəxslər) yeni 120.1.6-cı bənd əlavə edilməsi təklif olunur.

Sputnik Azərbaycan məhkumluğu olan hansı şəxslərin övladlığa uşaq götürmək hüququndan məhrum olunduğunu araşdırıb. Əmək və Əhalinin Sosial Müdafiəsi Nazirliyinin (ƏƏSMN) Əlillik siyasəti şöbəsinin müdir müavini Fərhad Ələkbərov Sputnik Azərbaycan-a açıqlamasında bildirib ki, indiyədək ölkəmizdə məhkumluğu olan şəxslərə övladlığa uşaq verilməsinə qanunla məhdudiyyət olmayıb: “Məlumdur ki, Azərbaycanda övladlığa verilmə ilə bağlı qaydalar yenidən hazırlanır. Ona görə də Ailə Məcəlləsi haqqında qanunvericiliyə müəyyən dəyişikliklərin edilməsi vacib idi. Ailə Məcəlləsinə dəyişiklik layihəsinə əsasən, məhkumluğun götürülməsi və ödənilməsi nəzərə alınmadan, sülh və insanlıq, ictimai təhlükəsizlik və ictimai mənəviyyat əleyhinə, həyat və sağlamlıq, şəxsiyyətin azadlığı və ləyaqəti, şəxsiyyətin cinsi toxunulmazlığı və cinsi azadlığı əleyhinə, yetkinlik yaşına çatmayanlar və ailə münasibətləri əleyhinə qəsdən törədilən ağır və ya xüsusilə ağır cinayətlərə görə məhkum olunmuş şəxslər və bu cinayətləri törətdiyinə görə barəsində cinayət tətbiqinə bəraətverici əsaslar olmadan xitam verilmiş şəxslər övladlığa uşaq götürə bilməzlər. Layihədən də görünür ki, bu məhdudiyyət bütün məhkumluğu olan şəxslərə şamil olunmur”.

Nazirliyin (ƏƏSMN) Əlillik siyasəti şöbəsinin müdir müavini Fərhad Ələkbərov bildirir ki, əvvəllər praktikada olsa belə, məhkumluğu olan şəxslərin övladlığa uşaq götürməsi ilə bağlı ayrıca statistika mövcud olmayıb: “Ola bilər ki, praktikada belə hallar olub. Çünki əvvəllər qanunda məhkumluğu olan şəxslərin övladlığa uşaq götürmək məsələsi ümumiyyətlə qanuna salınmayıb”.

F. Ələkbərov bu müddəanın qanuna salınmasının vacib olduğunu söyləyib. Həmsöhbətimiz deyir ki, infeksion xəstəlikləri olanlar da övladlığa uşaq götürə bilməzlər. Buraya əvvəllər valideyn hüququndan məhrum olmuş şəxslər də daxildir.

İnsan hüquqları üzrə Müvəkkili (Ombudsman) Aparatının rəhbəri Aydın Səfixanlı Sputnik Azərbaycan-a açıqlamasında məhkumluğu olan bir sıra şəxslərə övladlığa uşaq götürməyə qoyulan qadağanın hüquqi baxımdan normal olduğunu söyləyib. O qeyd edib ki, bu, qətiyyən həmin şəxslərin hüquqlarının pozulması kimi qiymətləndirilə bilməz: “Təbii ki, övlad sahibi olmaq hər kəsin arzusudur. Amma övladlığa verilmədə ən həssas məqam övladlığa götürənin yox, uşağın gələcəyidir.

Bu baxımdan həyat və sağlamlıq, şəxsiyyətin azadlığı və ləyaqəti, şəxsiyyətin cinsi toxunulmazlığı və cinsi azadlığı əleyhinə, yetkinlik yaşına çatmayanlar və ailə münasibətləri əleyhinə qəsdən törədilən ağır və ya xüsusilə ağır cinayətlərə görə məhkum olunmuş şəxslərə övladlığa uşaq verilməsinin qadağan edilməsi normaldır.

Övladlığa verilən uşağın sağlam mühitdə böyüyüb tərbiyə alması vacibdir. Uşaqları sadalanan cinayətlərə görə məhkum edilmiş şəxslərə övladlığa vermək onların həyatını təhlükəyə atmaq deməkdir”.
